General


The seller of the device to Remarketed.nl “hereinafter customer” can offer her device for sale to Remarketed.nl hereinafter “purchaser”. The device is sent for inspection to the inspector Remarketed, hereinafter “Inspector”. This does not alter the fact that the agreement with its obligations of transfer and payment is between Remarketed.nl and the customer.

Personal information

 

Customer personal data is processed in accordance with all GDPR regulations.

SIM cards and memory cards or the data on these devices must be removed before the customer sends the device. Remarketed.nl cannot be held liable for loss of these components or the data on these data carriers. Upon completing the trade-in process, the customer agrees to these terms and conditions. SIM cards and memory cards are immediately thrown away if discovered. The customer must send a device without associated accessories.

If the customer sends the device with accessories, Remarketed.nl is not responsible for returning the accessories. A device should be sent without the so-called iCloud or Android lock. The device must also be reset to factory settings. If this is not the case, Remarketed.nl reserves the right to cancel the purchase and return the device.



For Apple products, the seller must deactivate 'Find my iPhone' and remove the device from iCloud. For Android phones, the seller must disable 'Android Device protection'.



Products that arrive without a lock and have not been reset to factory settings can be reset to factory settings by Remarketed without prior explicit permission from the customer. The customer agrees to this during the trade-in process once they have arrived at the confirmation landing page and completed the process. If the iCloud lock is present, buyback.Remarketed or Remarketed can contact the customer to remove the iCloud lock with the iCloud password with the customer's explicit permission. The customer must change the iCloud password immediately after this action.

 

Customer obligations

The seller must be at least 18 years old. If this is not the case, it is assumed that the device has been sold to Remarketed.nl with the consent of the guardian or parents, unless the parents or guardian states otherwise. Fo may assume that the seller is the owner of the device and that there are no liens or other limited rights on it. The seller guarantees that the device has not been put into circulation due to theft, fraud or other unlawful act that is contrary to the law or the law. The statutory rights of the consumer are not affected by these terms and conditions.

 

Shipping the product

Customer must send the product with the shipping label provided by Remarketed.nl. This means the shipment is insured and the shipment can be arranged free of charge for the customer. If the customer chooses a different shipping method, the shipping costs and the risk of missing shipment are for the customer.

 

Product packaging

The customer is responsible for proper packaging of the product. A sturdy cardboard box with filling should be used for this to reduce the risk of damage during transport.

 

Evaluation of the product (onsight)

The customer answers questions truthfully for an accurate price indication. If it turns out that the device does not meet the condition specified by the customer, an alternative offer can be made.

 

Contractual conclusion

The prices on the trade-in website of Remarketed.nl do not constitute a binding offer within the meaning of Dutch law. As soon as the price indication has been accepted by the customer, the device is sent to the Controller. Together, this counts as an offer within the meaning of civil law. Acceptance from Remarketed.nl only applies when the check by the inspector Onsight has been completed and there is an intention to transfer the price. At that time, the purchase agreement is concluded, after which there is an immediate transfer of ownership from the customer to Remarketed.nl with the title of the sales agreement from the customer to Remarketed.nl, at the same time an obligation is created to transfer the purchase price from Remarketed.nl to the customer. .

 

Acceptance from Remarketed.nl

Remarketed is completely free in its decision to refuse any offer without stating reasons. For the sake of transparency, a reason is shared. After receiving the product, the inspector will assess the device within 7 working days. As soon as the inspection has been completed and the purchase agreement has been concluded, Remarketed.nl will proceed to payment of the purchase price within 7 working days. If there is an unexpected event that should be borne by Remarketed.nl, Remarketed.nl can extend the period by 7 working days.

 

Liability

By shipping the product, the seller undertakes to indemnify Remarketed.nl against justified claims from third parties, such as ownership or limited rights, insofar as these relate to the nature of the product. By sending the product to Controller, the seller undertakes to compensate all damage, including the costs incurred by a necessary use of legal assistance, that Remarketed.nl incurs in connection with the shipped product. This applies, among other things, to the following cases: counterfeit products, stolen goods and other claims from third parties that arise because this good has been purchased by Remarketed.nl. It can be assumed that Remarketed.nl acts in good faith, because the seller has agreed to the general terms and conditions and must therefore comply with the guarantee that the device has not been put into circulation due to theft, fraud or another unlawful act that is in conflict with is with the law or justice.

 

Application of law

Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
